Cleaners NW2 Service Terms and Conditions

These Terms and Conditions govern the provision of cleaning services by Cleaners NW2 to residential and commercial clients. By booking or receiving any service, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Client means the individual or business that requests or receives cleaning services.

Company means Cleaners NW2, the service provider.

Services means any cleaning, tidying, or related work provided by the Company.

Premises means the property or location at which the Services are to be carried out.

Cleaner means any employee, contractor, or representative engaged by the Company to perform the Services.

Booking means a confirmed request for Services accepted by the Company.

2. Scope of Services

The Company provides regular and one-off cleaning services to households and businesses within its service area, including but not limited to routine domestic cleaning, deep cleaning, end of tenancy cleaning, and commercial cleaning.

The specific scope of each Booking, including tasks to be carried out, duration, frequency, and any special requirements, will be agreed in advance between the Client and the Company. Only tasks that are explicitly agreed or are reasonably incidental to the agreed tasks are included in the Services.

The Company reserves the right to decline any task that is unsafe, requires specialist equipment or qualifications not held by the Company, is outside the agreed scope, or is contrary to health, safety, or environmental regulations.

3. Booking Process

All Services must be booked in advance. A Booking is made when the Client provides the necessary information about the Premises and the requested Services, and the Company confirms the Booking.

The Client must provide accurate information regarding the size and condition of the Premises, access arrangements, and any particular requirements or hazards. The Company may amend the quoted price or duration if the information provided is inaccurate or incomplete.

Bookings are subject to availability. The Company does not guarantee the availability of particular dates, times, or specific Cleaners. The Company will use reasonable efforts to accommodate the Client's preferences, but reserves the right to assign any suitably trained Cleaner to a Booking.

The Company may, at its discretion, require an initial deposit or pre-authorisation before confirming a Booking. Any such requirement will be communicated before the Booking is finalised.

4. Access to the Premises

The Client is responsible for providing safe and timely access to the Premises for the duration of the Booking. This may include arranging key collection or ensuring that someone is present at the agreed start time.

If the Cleaner is unable to gain access to the Premises within 20 minutes of the agreed start time due to circumstances within the Client's control, the Company may treat the Booking as cancelled by the Client and apply the relevant cancellation charge.

The Client must ensure the Premises is safe to enter and work in, including but not limited to secure flooring, adequate lighting, and the absence of hazardous materials that have not been disclosed in advance.

5. Client Responsibilities

The Client agrees to:

Provide access to water and electricity at the Premises.

Inform the Company in advance of any special instructions, fragile items, or areas that must not be cleaned.

Secure or remove valuables, important documents, and items of sentimental value before the start of the Services.

Ensure that any equipment or products provided by the Client for use by the Cleaner are safe, in good working order, and suitable for the intended tasks.

Comply with all applicable health, safety, and environmental laws and regulations.

6. Cleaning Products and Equipment

The Company may provide its own cleaning products and equipment as part of the Services unless otherwise agreed. Where the Client requests the use of specific products or equipment supplied by the Client, this must be agreed in advance.

The Company does not accept liability for any damage or adverse effects arising from the use of products or equipment supplied by the Client or from following the Client's specific instructions about such products or equipment.

The Client must inform the Company in advance of any allergies or sensitivities relevant to the choice of cleaning products. The Company will use reasonable efforts to accommodate such requests but cannot guarantee that all products will be allergen free.

7. Pricing and Quotations

Prices for the Services may be provided as an hourly rate, fixed fee, or a combination of both, depending on the nature of the Booking. All prices will be communicated to the Client before the Booking is confirmed.

Any quotation provided by the Company is based on the information provided by the Client and is subject to revision if the actual condition or size of the Premises differs materially from that described. The Company will notify the Client of any required adjustment to the price or duration as soon as reasonably practicable.

Unless explicitly stated otherwise, all prices are exclusive of any applicable taxes that may be imposed by law. Any such taxes will be added to the total amount payable by the Client when required by law.

8. Payments

Payment terms will be communicated at the time of Booking. The Company may require payment in advance, at the time of service, or within an agreed period after completion of the Services.

Accepted methods of payment will be notified to the Client when the Booking is made. The Company reserves the right to change accepted payment methods from time to time.

Where payment is not made in full by the due date, the Company may suspend further Services until all outstanding amounts are settled. The Company may also charge reasonable administrative costs and interest on overdue amounts, in accordance with applicable law.

Any dispute regarding an invoice must be raised by the Client in writing within 7 days of the date of the invoice. Failure to do so will be deemed acceptance of the invoice as correct.

9. Cancellations and Rescheduling

The Client may cancel or reschedule a Booking by providing notice to the Company. Specific notice periods and charges are as follows unless otherwise agreed in writing:

More than 48 hours before the scheduled start time: no cancellation fee.

Between 24 and 48 hours before the scheduled start time: the Company may charge up to 50 percent of the agreed price.

Less than 24 hours before the scheduled start time or no access provided at the time of the Booking: the Company may charge up to 100 percent of the agreed price.

The Company may cancel or reschedule a Booking where necessary due to staff illness, operational issues, unsafe conditions at the Premises, or events beyond its reasonable control. In such cases, the Company will use reasonable efforts to provide an alternative date or replacement Cleaner. If no suitable alternative can be offered, any prepaid amounts for the affected Booking will be refunded.

10. Service Quality and Complaints

The Company aims to provide a high standard of service. If the Client is dissatisfied with any aspect of the Services, the Client must notify the Company as soon as reasonably possible, and in any event within 24 hours of completion of the relevant service visit.

Where a complaint is justified, the Company may, at its discretion, offer to re-perform the relevant part of the Services, provide a partial refund, or offer a discount on future Services. Any remedy will be limited to the value of the affected portion of the Services.

The Company will not be obliged to remedy any issues arising from circumstances outside its control, including but not limited to excessive wear and tear, pre-existing damage, the use of unsuitable products or equipment supplied by the Client, or a failure by the Client to provide accurate information.

11. Liability and Limitations

The Company will exercise reasonable skill and care in providing the Services. However, the Company's liability to the Client is limited as follows:

The Company will not be liable for any indirect, consequential, or purely economic loss, including but not limited to loss of profit, loss of business, or loss of opportunity.

The Company will not be liable for any loss or damage arising from inaccurate or incomplete information provided by the Client, or from the Client's failure to comply with these Terms and Conditions.

The Company will not be liable for any loss or damage to items of a particularly fragile, delicate, or high value nature, including but not limited to art, antiques, jewellery, or cash, unless such items were specifically disclosed in writing to the Company before the Booking and the Company expressly accepted responsibility.

The Client is responsible for ensuring that all valuables are safely stored and that the Premises is adequately insured. The Company recommends that the Client maintains appropriate home, contents, or business insurance.

Nothing in these Terms and Conditions excludes or limits the Company's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

12. Waste Handling and Environmental Regulations

The Company will handle ordinary household and commercial waste generated in the course of providing the Services in accordance with applicable waste and environmental regulations.

The Company is not a licensed waste carrier for the removal of large volumes of waste, hazardous waste, construction debris, or electrical and electronic equipment. The Client is responsible for arranging appropriate disposal of such materials and must not request the Cleaner to remove or transport any waste that would breach applicable regulations.

Where the Client requests assistance with waste handling, such requests must comply with relevant laws, and may be subject to additional charges. The Company reserves the right to refuse to remove or handle any material that it considers hazardous, unlawful, or outside the normal scope of domestic and commercial cleaning.

The Client agrees not to request or require the Cleaner to dispose of any substances in drains, sinks, or external areas in a manner that contravenes environmental or local authority regulations.

13. Health and Safety

The Company has a duty to protect the health and safety of its Cleaners and Clients. The Client agrees to cooperate with the Company in maintaining a safe working environment at the Premises.

The Cleaner may suspend or modify the Services if conditions at the Premises are considered unsafe, including but not limited to the presence of aggressive animals, hazardous materials, or structural defects. In such cases, the Company may treat the Booking as cancelled by the Client and apply the applicable cancellation charges.

The Client must notify the Company in advance of any known health and safety risks at the Premises. The Company may decline or terminate the Services if it reasonably believes that continuing would pose an unacceptable risk.

14. Keys and Security

Where the Client provides keys or access codes to the Company, these will be handled with reasonable care. The Company will not label keys with the full address of the Premises.

The Company accepts no liability for any security incident that is not directly caused by the negligence of the Company or its Cleaners. The Client remains responsible for securing the Premises and for ensuring that all doors and windows can be locked or secured.

15. Personal Data

The Company may collect and process personal data about the Client for the purpose of managing Bookings, providing the Services, handling payments, and responding to enquiries or complaints.

The Company will process personal data in accordance with applicable data protection laws and only retain such data for as long as necessary for the purposes for which it was collected or as required by law.

16. Force Majeure

The Company will not be liable for any delay or failure to perform its obligations under these Terms and Conditions where such delay or failure is due to events beyond its reasonable control, including but not limited to extreme weather, power failure, transportation disruption, pandemic, strikes, or other industrial disputes.

Where a force majeure event occurs, the Company will notify the Client as soon as reasonably practicable and will use reasonable efforts to resume the Services as soon as it is safe and feasible to do so.

17. Amendments to Terms

The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Booking will apply to that Booking, unless a change is required by law or regulation.

The Company may publish updated Terms and Conditions on its website or otherwise make them available to Clients. Continued use of the Services after any changes are communicated will constitute acceptance of the revised Terms and Conditions.

18. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, including any non-contractual disputes or claims.

19. General Provisions

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.

No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

The Client may not assign or transfer any of their rights or obligations under these Terms and Conditions without the prior written consent of the Company. The Company may assign or subcontract its rights and obligations as it deems appropriate, provided that this does not reduce the level of service owed to the Client.

These Terms and Conditions, together with any written confirmation of a Booking and any other documents expressly incorporated by reference, constitute the entire agreement between the Client and the Company in relation to the Services and supersede any previous agreements or understandings, whether written or oral.
